Sharing Your Personal Information

An Important Note About Minors

What Personally Identifiable Information Do We Collect and How Is It Used?

  1. Registration. We collect your name, email address, telephone numbers, address, and time zone as part of the registration process for Your submission of this information enables you to access and participate in the services and enables us to communicate with you regarding these services, as well as about other products, services, and opportunities we believe may be of interest to you. At times this communication may be effected through a third party communications company, who will be instructed to maintain the privacy of your information and use it solely for the purpose of communicating with you on our behalf. We may also use this information in aggregate form to help us improve our products and services and engage in related research activities. In addition, if you send messages through our internal messaging system, we will collect that information. We retain this information as necessary to resolve disputes, provide customer support, improve our products and troubleshoot problems as permitted by law. If you send us personal correspondence, such as emails or letters, or if other clients, visitors, or third parties send us correspondence about your activities, postings, or submissions on the Portal, may collect such information in a file specific to you.
  2. Health and Medical Information. The Portal enables you to upload and input your health and medical data so that Constant MD can help you store, organize, and analyze this information. ConstantMD staff will not view your health information or communicate with any other party regarding your health information.You may opt to grant your health care provider access to this information. If you subscribe to’s Web Monitoring Connection, the Monitoring Provider you designate will be able to view this information and communicate with you regarding it. By inputting your health and medical data and subscribing to this service, you signify your consent to allowing your Monitoring Provider to view your chart. If you subscribe to’s Reminder Service, a third party communications company will receive the minimum amount of information necessary to provide you with the type of reminders you request. As with the Web Monitoring Connection, by inputting your health and medical information and subscribing to the Reminder Service, you consent to this limited disclosure of your information.
  3. Under the Family Plan, each individual family member above the age of 18 maintains exclusive access to his/her health and medical information. Each individual above the age of 18 maintains a separate and confidential username and password. The individual may opt to grant other family members partial or complete, ongoing or temporary access to his/her chart. Family members under the age of 18 must have their parent/guardian’s consent to use the services, and these parents/guardians will have access to the minor individual’s chart.
  4. Under the Group Plan, the group administrator will manage the account of each individual enrolled in the service. Administrators will therefore have access to the charts of the individual group members.
  5. Upon the termination or non-renewal of your subscription, will cease to store, maintain, deliver, or provide access to your health and medical information, and your right to access this information through the portal will terminate. Please see the Terms and Conditions of Use for information on how to obtain a copy of your chart.
  6. Messages to When you contact us directly with any questions or comments you may have, either via email, or for logged-in clients, through our online form, we use this information to respond directly to your questions or comments. We may also file your comments to improve the web services and offering, or review and discard the information.
  7. Subscription to Services. If you subscribe to services, we will collect additional information, which may include a billing address, credit card number, a credit card expiration date, and, if you are purchasing services on behalf of a minor, your relationship to the minor (e.g., parent, guardian). This information will be used to process and complete your payment. It may also be used in aggregate form by ConstantMD, either independently or with third party research institutions, for product improvement, research, and studies related to ConstantMD services.
  8. Opt-in Programs. If you have indicated that you are interested in learning more about ConstantMD and/or and our offerings, or if you have elected to receive our newsletter or other publications, we will collect contact information such as name, email address, phone number, and address. This information will only be used to contact you to provide you with further information about our products and services as you have requested.
  9. Demographic Information. We automatically track certain information based on your behavior on the Portal. We use this information to do internal research on our clients’ and visitors’ demographics, interests, and behavior to better understand, protect, and serve you. This information may include the URL that you just came from (whether this URL is on the Portal or not), which URL you next go to (whether this URL is on the Portal or not), your computer browser information, and your IP address.’s Use of Cookies

  1. A “cookie” is a small file placed on your hard drive that tracks non-personally identifiable information such as the number that represents you as a user in our system. We use cookies to track your log-in to the Portal’s services. We also use cookies to allow you to enter your password less frequently during a session. You are always free to decline our cookies if your browser permits, although in that case you may not be able to use certain features on the Portal and you may be required to reenter your password more frequently during a session.
  2. Additionally, you may encounter "cookies" or other similar devices on certain pages of the Portal that are placed by third parties. For example, if you view a web page created by a Client, visitor, or user, there may be a "cookie" placed within that web page. We do not control the use of cookies by third parties.

With Whom Do We Share Your Information?

  1. As noted above, if you subscribe to the Web Monitoring Connection, the provider you designate as your monitoring provider will be able to see the health information you store in your chart. If you grant access to other individuals through the Portal’s “Grant Access Module,” these individuals will also be able to view the information in your chart. You, the client, control this type of access; you may revoke such access at any time.
  2. If you purchase the Reminder Service, we will disclose the minimum amount of information necessary to the third party delivering the reminder to enable them to fulfill your request.
  3. We never sell or rent your personal information without your consent. However, ConstantMD may release personal information under the following circumstances.
  4. Where release is required by law (for example, a subpoena) or regulation or is requested by a government agency; or To appropriate persons, where your communication suggests possible harm to others.
  5. Further, as discussed above under “Subscription to Services,” if you purchase a subscription or other services from ConstantMD, we will collect billing-related information from you, such as a credit card number and billing address. We may share that information with a third party solely for the purpose of processing your order. We may also use that information in aggregate, non-personal form to improve our services and products or provide reports about their performance.

Choices Regarding the Use of Your Information

  1. Discontinue Receiving Email Publications. To stop receiving email publications, go to your account at, select the “Profile” link on your account page, and change your email options.
  2. Access and Update Your Information. You can view and update your account information on the web by logging in and selecting the profile link, or in the program by logging in and choosing the “Profile” button.’s Information Security Measures

  1. ConstantMD is committed to protecting your privacy and your information. We have taken extensive measures to prevent the loss, misuse, and alteration of your information. All personal information we receive from you is stored behind a firewall. All ConstantMD employees and independent contractors are aware of our privacy and security policies. This information is only accessible to those employees and independent contractors who need it in order to perform their jobs.
  2. If you order services or other products from us, we may share your information with a third party solely for the purpose of processing your order. In the rare instance that an unauthorized person obtains your credit card information and uses it, by federal law, you are only liable for the first $50. In any instance where you have discovered or suspect fraud, you must contact your credit card company immediately. Please be assured that all of your information is transmitted via a secure connection using industry standard internet security protocols
  3. In the event that any of your personal information is lost or improperly disclosed, we will inform you via email using the email address you submit in your record. As noted above, it is your responsibility to ensure ConstantMD/ has a current and secure email address through which to contact you.

Provision of Medical Records to Clients.

  1. You may request a copy of the medical and health records in your chart by sending an email to If you request a hard copy of your chart, you will be charged a $0.25 per page copying fee. You will also be responsible for covering the costs of shipping. You must pay these costs before can process your request. Once you have submitted payment, will provide you with your records within fifteen (15) days. If you prefer an electronic copy of your records, we will charge a reasonable administrative fee based on the volume of documents in your chart; the records will be emailed to you at your email address of record.

Notification of Changes

  1. If we are going to use your personally identifiable information in a manner different from that stated at the time of collections through our then-existing privacy policy, we will notify you via email. You will have a choice as to whether or not we use your information in this different manner. In addition, if we make any material changes in our privacy practices, whether or not these changes apply to information already collected through the Portal, we will post a prominent notice on the Portal notifying clients and visitors of the change.

Your Communications with ConstantMD/

  1. When you send us an email or visit the Portal, you are communicating with us electronically. When you send us an email, you consent to receive communications from us electronically in response. We may communicate with you by email, or by updating or posting notices on the Portal. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communication be in writing. All communications with us become the property of ConstantMD.

Your Role in Maintaining Privacy

Your Consent

  1. You acknowledge that this privacy policy is part of the Portal’s Terms and Conditions of Use and you agree that using the Portal signifies your assent to the privacy policy. ConstantMD reserves the right to change the terms of service, including this privacy policy, at any time, without advance notice.
